Federal Court orders Police, DSS to stop reinstatement of Muhammadu Sanusi as Emir of Kano

The Kano division of the Federal High Court on Thursday ordered Kano State government to halt the implementation of the Kano State Emirates Councils (Repeal) Law, 2024 (1445 A. H).

The law, which was signed into law on the 23rd day of May 2024 by Governor Abba Kabir Yusuf, did away with the four new emirates created by a previous law put in place by former Governor Abdulahi Ganduje.

The law also removed Alhaji Aminu Ado Bayero as the Emir of Kano, and reinstated Mallam Muhammadu Sanusi II as emir.

But, Justice A. M. Liman, on the same day, ordered the state Commissioner of Police Police and DSS to stop Kano State government, the state House of Assembly, the Speaker of the State House of Assembly and the Attorney General of the state from enforcing, implementing and executing the law.

Specifically, the judge barred the Poilice Commissioner and the DSS from “enforcing, executing, implementing and operationalizing the Kano State Emirate Council (Repeal) Law 2024 (1445 A. H.).

The judge said the interim order became necessary in order to maintain peace and security in Kano State.

He also ordered all parties in the matter, which was instituted by Sarkin Dawaki Babba, Alhaji Aminu Babba DanAgundi, to maintain status quo pending the determination of the fundamental rights application before the court.

He adjourned the case to 3rd June for the hearing of the fundamental rights application.
