Ganduje cannot be made APC’s national chairman – Lawyer
It is presently practically impossible for former Kano State governor, Abdullahi Umar Ganduje, to become the national chairman of Nigeria’s ruling party, the All Progressives Alliance (APC).
A Lokoja-based legal practitioner, Nathaniel S. Olijeh, told Nigerian Sketch on Thursday that it is not an easy task for the APC to just bring Ganduje on board unless the party’s constitution “is to be subjected to serious disregard.”
And that will be illegal and voidable because it would be unconstitutional, he said.
A section of the Nigerian press on Thursday reported that Ganduje was being considered for the position following the controversial resignation of the former chairman, Abdullahi Adamu, on Tuesday.
Olijeh however said there was no way Ganduje could be APC chairman under the party’s constitution unless the constitution would be disecrated.
“This is simply a constitutional issue. What APC’s constitution says is that when the chairman vacates office, the deputy chairman would hold forth in acting capacity.
“Since Ganduje is not APC’s deputy chairman, he could not take the position. Abba Kyari, who is already holding forth, is the one to remain there until the needful is done.
“How do you remove the acting chairman and bring Ganduje without holding a convention?
“I think they can only do that ‘technically’ if they will dissolve the National Working Committee (NWC) and bring in a caretaker committee which Ganduje will head”, he said.
He added that another political concern is that “the party’s chairmanship position has been zoned to North-central Nigeria, and Ganduje is not from that zone. He is from the North-west.
“Are they going to disregard their own political arrangement and do something contrary to what have agreed upon? We are watching them.
“I’m aware that the party’s NEC may organize a mini-convention, but some certain processes must be followed which do not allow for sudden replacement as the Nigerian media are insinuating. I want to see how they will circumvent all these.”
