KANO Emirate: Real reason Aminu Bayero’s lawyers withdraw from Kano High Court case

An application for Stay of Proceedings and another for adjournment in order to reply to a motion led to mass withdrawal of appearance before Justice Amina Adamu Aliyu of the Kano Sate High Court on Thursday.

It was in a case filed by the Attorney General of Kano State and the Speaker of the state’s House of Assembly seeking to stop the 15th Emir of Kano, Aminu Ado Bayero and four other emirs from continuing to bear the title of emir, and to eject Bayro from a palace he has been occupying since his purported removal as Emir of Kano by Governor Abba Yusuf.

The real reason for withdrawal

The lawyers withdrew their representations as a mark of dissatisfaction with the court’s disposition to their application for stay of proceedings in the matter.

The real reason is that they believe the judge has been biased and may not be fair to Aminu Bayero.

Abdul Muhammed Rafindadi, SAN, informed the court that they have filed motion for stay of proceedings at the Court of Appeal seeking that the High Court halts its move to hear some applications when it had not resolved their request for Hon Justice Amina Adamu Aliyu to recuse herself from the case due to issues bothering on alleged lack of fair hearing, bias and loss of confidence.

The lawyer said they have filed an affidavit of fact as a means to notify the High Court of the motion for stay at the appeal court

He said “When a judge of a High Court is aware of application in a higher court, the notification in the dependency in the lower court must be in affidavit of facts. It is expected that at a trial court should stop the hearing on the matter pending the hearing and determination of the motion on notice.”

Muhammed urged the court to stay the proceedings pending the hearing and determination of the motion on notice.

Justice Amina however ruled that since she did not see any element of urgency in the motion filed before the appeal court, she will proceed.

Also, Rafidadi told the court that his team was served with court processes Wednesday night and another Thursday morning, and that they require an adjournment to be able to study and respond to the two.

Justice Amina refuses to adjourn, saying they have had enough time to respond.

It was at this point that Rafindadi applied to the court to withdraw from the case. His application was granted by the court.

As the court was about to proceed in the case, Sanusi Musa, SAN, also stood to apply to withdraw together with other lawyers. His application was also granted, leaving Aminu Bayero with no representation in the case.

The court however proceeded to hear other issues in the case.

All attempts to get some of the lawyers involved the matter from the sides of the plaintiffs and the defendants failed, as the claimed that Justice Aminu had openly forbade them from speaking to the press.
