Muaz Magaji’s case further adjourned due to ‘security reason’

The criminal defamation case against former Kano State commissioner of works, Muaz Magaji, which was adjourned from Monday till today (Thursday) for ruling on bail application, could not be heard as the case suffered further adjournment to Friday, February 4.

The registrar of Court 58, Nomansland, Auwal Tudunwuzirci, wrote a letter to counsel in the case on Thursday, intimating them of the fact that the case has been adjourned by the court.

According to the letter, the adjournment was to avoid overwhelming security personnel in the state because Magaji’s case clashed with another case it considered to be high-profile, involving Abduljabbar Nasiru Kabara.

The letter read in part that “… due to security reasons and since the same security personnel will be at USC K/Kudu [Upper Shariah Court Kofar Kudu where Mr Kabara is being tried] this case is further adjourned to 4th February, 2022 by 2:30pm.”

Magaji was a former commissioner in Governor Ganjude’s cabinet, but was sacked last year following what the government considered unpalatable comments after the death of President Buhari’s chief of staff, late Abba Kyari.

Magaji, known to be critical-minded, turned critical of the governor and later joined a faction of the All Progressives Congress (APC) in the state, which is locked in party leadership tussle with another faction backed by the governor.

The former commissioner is facing a four-count charge bordering on defamation of character, intentional insult, injurious falsehood and inciting public disturbance against Ganduje.

The charges, to which he pleaded not guilty on Monday, contravened Sections 392, 399 and 114 of the Administration of Criminal Justice of Kano State 1999.

He will have to spend another day in prison before knowing the fate of his bail application.
