WAI Condemns Kano Assembly as Rubber Stamp, Demands Return of Suspended Kano PCACC Boss

A Kano-based non governmental organization, War Against Injustice (WAI), has called on Kano State government to return the chairman of the Public Complaint and Anti-Corruption Commission (PCACC),Muhuyi Magaji Rimingado to office.

The organization said it requested for relevant information and documents on the suspension of Muhuyi from the Kano State House Of Assembly under the Freedom of Information Act, 2011, and that after it has scrutinized the information, it found that the reasons given for the suspension of the chairman were not tenable.

WAI believes the PCACC chairman, should have accepted the posting of an  accountant to his office, and that his rejection of the posting was “contrary to the section 28 (d) of the Kano State Public Financial Management Law 2020, which gives the Accountant-General power to provide accounting staff to each government ministries or extra ministerial department (MDAs).

“If his hands are clean, then why did he refuse to accept him? Muhyi Magaji Rimin Gado is wrong.”

The body however said “Kano State House of Assembly lacks jurisdiction to suspend Muhyi Magaji Rimin Gado. And the House itself denied his suspension, hence who suspended him?

“Any decision reached without jurisdiction is null, void and of no legal effect whatsoever.

“Therefore Muhyi Magaji Rimin Gado is still legally the Executive Chairman of Kano State Public Complaints and anti-corruption Commission.”

The body said it observed that “The Kano State House of Assembly‘s intervention in this matter isn’t for the sake of violating the said law, rather to maintain and protect the interest of the executive arm of government because several complaints, demands and petitions were sent to the House by the good people of Kano State and Civil Society Organizations including War Against Injustice, but no action was taken or positive response from the House..”

It also regretted that the fight against corruption has been politicized and said “The people of Kano State need a proactive parliament that can protect their interest and the interest of the state not rubber stamp parliament.”

WAI said its main objective is to create an awareness against social and political violations of fundamental rights and other forms of injustice in the society.
