Nigeria threatens sanction against Elon Musk’s Starlink for alleged illegal price hike
The Nigerian Communications Commission (NCC) has announced its intention to take enforcement action against Starlink, the satellite internet service owned by Elon Musk, due to a significant increase in subscription prices that was implemented without regulatory approval.
This situation raises several important points regarding the actions taken by Starlink and the regulatory framework governing telecommunications in Nigeria.
Recently, Starlink raised its monthly subscription fee by 97%, increasing it from ₦38,000 to ₦75,000.
Additionally, the cost of the installation kit for new users rose from ₦440,000 to ₦590,000, marking a 34% increase.
Starlink attributed these price adjustments to “excessive inflation,” which they claimed necessitated the changes. However, this unilateral decision to raise prices has sparked controversy and led to scrutiny from the NCC.
Regulatory framework
According to Nigerian law, specifically Sections 108 and 111 of the Nigerian Communications Act (NCA) of 2003, telecommunications operators are required to seek approval from the NCC before making any changes to their service tariffs. Section 108 explicitly prohibits licensees from imposing charges for services without prior approval from the commission. Section 111 empowers the NCC to impose financial penalties on any licensee that exceeds approved rates.
The NCC’s Director of Public Affairs, Reuben Muoka, expressed surprise at Starlink’s actions since they had previously submitted a request for a price adjustment that had not yet been approved. The NCC views this as a contravention of both the NCA and Starlink’s licensing conditions regarding tariffs.
“The action of the company appears to be a contravention of Sections 108 and 111 of the Nigerian Communications Act (NCA) 2003, and Starlink’s Licence Conditions regarding tariffs,” Muoka said.
Enforcement actions by the NCC
In response to this violation of regulatory protocols, the NCC has initiated pre-enforcement actions against Starlink as of October 3rd, 2024. While specific penalties have not yet been disclosed, it is clear that the commission is committed to maintaining regulatory stability within Nigeria’s telecommunications sector. The potential consequences for Starlink could include financial penalties or other sanctions aimed at ensuring compliance with local regulations.
