Late Hamza Abdullahi’s family faces lawsuit over inheritance in Tueton Industries

The family of the late AVM Hamza Abdullahi has been dragged to court over the inheritance of shares in Tueton Industries Limited, a company where he held a significant stake.

The case was initiated by Abdullahi Isa, a nephew of the deceased, who is seeking to appoint a provisional liquidator for the company.

This action comes in light of claims that since Hamza Abdullahi’s death on January 3, 2019, there has been no proper management or communication regarding the company’s operations or shareholding among the heirs.

According to the information provided in his affidavit, Abdullahi Isa asserts that his father, Isa Abdullahi, owned a 25% share in Tueton Industries Limited while Hamza Abdullahi held 75%.

The applicant contends that after Hamza’s passing, his heirs have failed to convene any meetings or appoint a board of directors for the company. This lack of governance has prompted Isa to seek judicial intervention.

Legal proceedings

The federal high court in Kano granted leave for Isa to advertise his petition in local newspapers and allowed him to appoint a provisional liquidator. The court’s decision underscores the importance of adhering to corporate governance standards and ensuring that shareholders’ rights are respected following an owner’s death.

Islamic Law

Isa Abdullahi argues that his father and Hamza Abdullahi were devout Muslims and that their estates should be distributed according to Islamic law. This aspect is crucial as it highlights how cultural and religious beliefs can influence legal proceedings surrounding inheritance.

The court has scheduled an adjournment for February 5, 2025, where it will review compliance with its orders regarding the appointment of a liquidator and other procedural matters. This timeline indicates that while initial steps have been taken, further legal processes will unfold as parties comply with court directives.

Hamza Abdullahi was a Nigerian statesman and military administrator who served as governor of Kano State from 1984 to 1985; and minister of the Federal Capital Territory from 1986 to 1989.

He joined the Nigeria Air Force in 1964, and attended the Nigeria Air Force Tactical Training Wing in Kaduna. From 1964 to 1966, he completed the Aircraft Technical Officer’s Course in West Germany, and later took part in the Nigerian Civil War effort.

 After the war, he was the Air Provost Marshal, Air Provost Group from 1971 to 1980; and also attended the Royal Military Police Training Centre in Chichester in 1974. He participated in the 1975 military coup d’état which brought General Murtala Mohammed to power;[3] and from 1980 to 1984 was the Group Commander, Ground Training Group in Kaduna.

He died on 3 January 2019, in a German hospital after a protracted illness.
