Court slams cost against ECWA, refuses request to vacate exparte order nullifying ‘illegal’ Kano Central DCC
Kano State High Court Vacation No. 2 sitting at Miller Road on Thursday awarded cost of N100, 000.00 against the Evangelical Church Winning All (ECWA).
In continuation of the case in which the court earlier nullified the inauguration of the ‘illegal’ Kano Central District Church Council, counsel for ECWA Church, Yakubu Bawa Saleh Esq, leading A. I. Ango Esq, approached the court to set aside the exparte order that nullified the inauguration and restrained Rev. Dr. Emmanuel O. Malomo and five others from parading themselves as excos of the said DCC.
He however later sort to withdraw the application.

While responding, the counsel for the Plaintiffs B. Y. Gambo esq leading Usman Ashafa Esq, Bala Nomau Esq and F.A. Zubairu vehemently objected to the application for withdrawal of the motion and insisted on its dismissal since they have already joined issues. He further asked for a cost of N200, 000:00.
The court in a detailed ruling dismissed ECWA’s application to vacate the exparte order and granted a cost of N100, 000.00 against ECWA
Nigerian Sketch had reported that the High Court had summoned ECWA president for contempt, due to his violation of the court orders.
The matter was further adjourned to the 23rd of September for ruling on the second leg of the application on whether the order exparte granted pending the hearing and determination of motion on notice still subsists.
