ICC issues arrest warrant for Israel’s Netanyahu, Hamas’ Al-Masri
The International Criminal Court (ICC) Pre-Trial Chamber on Wednesday issued an arrest warrant for Israeli Prime Minister Benjamin Netanyahu and his former Defence Minister Yoav Gallant
This decision follows a series of legal challenges and proceedings related to alleged war crimes and crimes against humanity committed during the ongoing conflict involving Israel and Palestinian territories.
The ICC’s jurisdiction over the situation in Palestine has been a contentious issue.
The court asserts its authority based on the territorial jurisdiction of Palestine, which was recognized following a formal agreement by Palestinian leadership to be bound by the court’s founding principles in 2015. Israel, while not a member of the ICC, has consistently challenged the court’s jurisdiction over its actions in this context.

In September 2024, Israel submitted two requests to challenge the ICC’s jurisdiction and sought to halt proceedings related to warrants of arrest for Netanyahu and former Defense Minister Yoav Gallant. However, on November 21, the ICC unanimously rejected these challenges. The Chamber determined that it could exercise jurisdiction without Israel’s acceptance and noted that prior notifications regarding investigations had already been communicated to Israel.
The arrest warrant for Netanyahu is significant as it marks him as the first Israeli leader to be summoned by an international court for actions taken against Palestinians amid ongoing hostilities. The charges against him include serious allegations such as “starvation as a method of warfare,” along with other crimes against humanity including murder and persecution.
The issuance of this warrant does not guarantee immediate arrest but may severely limit Netanyahu’s ability to travel freely to countries that are members of the ICC. His office has dismissed these charges as “absurd” and politically motivated, asserting that they are part of a biased agenda against Israel.
This development could have profound implications for international relations concerning Israel and its leaders. While Netanyahu maintains his stance on continuing military operations until stated objectives are met, this warrant introduces potential legal ramifications should he enter jurisdictions governed by ICC statutes.
Furthermore, alongside Netanyahu, another warrant was issued for Hamas official Mohammed Diab Ibrahim Al-Masri (Mohammed Deif), who is accused of orchestrating attacks against Israel. This dual issuance highlights the ICC’s focus on accountability for both state actors and non-state actors involved in conflicts characterized by severe human rights violations.
